AI Content & Ownership Policy
This AI Content & Ownership Policy ("Policy") explains how Benitra creates, processes, stores, and assigns rights relating to AI-generated content.
This Policy forms part of the Benitra Terms of Service.
If there is any conflict between this Policy and the Terms of Service, the Terms of Service shall prevail.
1. Purpose
Benitra is an artificial intelligence platform that assists users in creating marketing and creative content.
Benitra is an independent platform that integrates third-party AI models. It is not affiliated with or endorsed by any AI model provider.
Artificial intelligence is a tool that supports creativity and productivity. It does not replace human judgment.
Users remain responsible for reviewing all generated content before publishing, distributing, or using it commercially.
2. Types of AI Content
The Services may generate content including, but not limited to:
- Marketing videos
- Images
- Product visuals
- Storyboards
- Narration
- Voice synthesis
- Captions
- Marketing scripts
- Advertising copy
- Visual concepts
- Scene descriptions
- Motion prompts
- AI-enhanced creative assets
Additional content types may be introduced in future versions of the Services.
3. User Ownership of Uploaded Content
You retain ownership of all content you upload to Benitra.
This includes, without limitation:
- logos;
- trademarks;
- product photographs;
- brand assets;
- marketing materials;
- documents;
- prompts;
- business information;
- reference images;
- videos;
- audio files; and
- any other materials submitted through the Services.
Nothing in this Policy transfers ownership of your uploaded content to Benitra.
4. Ownership of AI-Generated Content
Subject to your compliance with the Benitra Terms of Service and applicable law, Benitra assigns to you any ownership rights it may have in AI-generated content created specifically in response to your requests.
This includes generated:
- videos;
- images;
- narration;
- captions;
- scripts;
- storyboards; and
- related creative assets.
You may use such generated content for personal or commercial purposes.
This assignment applies only to content generated specifically for your account.
5. Ownership Limitations
Because artificial intelligence systems rely on statistical prediction rather than traditional authorship:
Benitra cannot guarantee that:
- generated content is unique;
- generated content is original;
- generated content is copyrightable;
- generated content is free from third-party claims;
- identical or similar content will never be generated for another user.
Users remain responsible for evaluating generated content before commercial use.
6. Similar Outputs
Artificial intelligence systems may generate similar or identical outputs for different users.
This may occur because:
- prompts are similar;
- products are similar;
- factual information overlaps;
- AI models produce statistically similar results.
The existence of similar outputs does not imply that another user copied your content.
7. Third-Party AI Models
Benitra utilizes third-party artificial intelligence providers.
Depending on the requested functionality, your content may be processed using services provided by providers such as:
- OpenAI
- Anthropic
- ElevenLabs
- Fal.ai
- Suno
Benitra may add, remove, or replace providers without prior notice.
Third-party model names referenced in documentation or the product refer to integrations, not Benitra branding. Benitra is not affiliated with Google, OpenAI, Anthropic, ElevenLabs, Fal.ai, Suno, or their respective model creators.
8. AI Characters and Likeness
Benitra uses AI-generated fictional characters only for on-screen presenters and character references.
- Users may not upload photographs of real people for character generation.
- Benitra does not support deepfakes, face swaps, face manipulation, or impersonation of real individuals.
- Uploaded product images are scanned; images containing people are rejected.
9. Human Review
Unless explicitly stated otherwise:
Benitra does not manually review customer content during normal operation.
Limited access to user content may occur only when reasonably necessary for:
- technical support;
- debugging;
- fraud prevention;
- abuse investigations;
- security incidents;
- legal compliance;
- customer-requested assistance.
Access is limited to authorized personnel with a legitimate business need.
10. AI Model Training
Benitra does not use your private uploaded content or generated projects to train proprietary artificial intelligence models developed by Spinelo Ltd.
However, some third-party AI providers may process submitted information according to their own terms and privacy policies.
Users are encouraged to review the policies of those providers.
11. User Responsibilities
You are responsible for ensuring that uploaded materials:
- belong to you;
- are properly licensed;
- do not infringe intellectual property rights;
- comply with applicable law.
You are also responsible for reviewing all AI-generated content before:
- publication;
- advertising;
- commercial distribution;
- public presentation;
- customer delivery.
12. Commercial Use
Unless otherwise restricted by applicable law or third-party licensing terms, users may commercially use AI-generated content created through Benitra.
Commercial use includes, without limitation:
- advertising;
- social media marketing;
- websites;
- product promotions;
- customer campaigns;
- printed materials;
- presentations;
- digital publications.
Users remain responsible for verifying that generated content is suitable for its intended commercial purpose.
13. Brand Assets
When you upload logos, trademarks, product images, or other brand assets:
- you retain ownership;
- Benitra uses them solely to provide the requested Services;
- they are not used for advertising Benitra without your permission.
You represent that you have all necessary rights to upload such assets.
14. Generated Voice Content
If narration or voice synthesis is generated:
- users remain responsible for ensuring they have the legal right to create or use any cloned or custom voices;
- Benitra does not verify ownership of voice samples;
- users assume responsibility for compliance with applicable publicity, privacy, and intellectual property laws.
15. Generated Images and Videos
AI-generated visual content may unintentionally resemble:
- existing products;
- brands;
- locations;
- people;
- artistic styles;
- publicly available imagery.
Such similarities are an inherent limitation of artificial intelligence systems and do not necessarily indicate copying or infringement.
16. No Legal or Professional Advice
Generated content should not be interpreted as:
- legal advice;
- financial advice;
- medical advice;
- engineering advice;
- regulatory compliance guidance.
Users remain responsible for obtaining qualified professional advice where necessary.
17. Accuracy
AI-generated content may contain:
- factual inaccuracies;
- outdated information;
- hallucinations;
- translation errors;
- inconsistencies;
- incomplete information.
Users should independently verify important information before relying upon it.
18. Content Moderation
Benitra screens generative prompts through automated moderation before image and video generation. Benitra may also automatically block, limit, or reject generation requests that violate:
- applicable law;
- the Acceptable Use Policy;
- third-party provider requirements;
- platform security rules.
Uploads containing real people are rejected by automated vision checks. Benitra reserves the right to improve moderation systems over time.
19. Data Retention
Generated content and uploaded materials may be retained for the period necessary to:
- provide the Services;
- maintain project history;
- support regeneration;
- investigate abuse;
- comply with legal obligations.
Users may request deletion of their account in accordance with the Privacy Policy.
20. Future AI Improvements
Benitra continuously improves its generation technologies.
As AI providers evolve, future generations may differ in:
- quality;
- creativity;
- realism;
- consistency;
- available features.
Users acknowledge that identical prompts submitted at different times may produce different results.
21. Limitation of Responsibility
Benitra does not guarantee that AI-generated content:
- is legally protected;
- is free from infringement claims;
- is accepted by advertising platforms;
- achieves marketing goals;
- generates sales;
- performs better than human-created content.
Business decisions based on generated content remain the sole responsibility of the user.
22. User Responsibility for Publication
Before publishing or distributing AI-generated content, users should determine whether disclosure is legally required under applicable laws or platform policies.
Compliance with AI disclosure, advertising, consumer protection, intellectual property, and privacy laws remains the user's responsibility.
23. Policy Updates
Artificial intelligence regulation is rapidly evolving.
Benitra may update this Policy to reflect:
- legal developments;
- technological changes;
- new AI capabilities;
- updated provider requirements;
- industry best practices.
Updated versions become effective upon publication unless otherwise required by law.
