Acceptable Use Policy

This Acceptable Use Policy ("Policy") explains the rules governing your use of the Benitra platform, website, APIs, applications, and related services (collectively, the "Services").

This Policy forms an integral part of the Benitra Terms of Service.

By using the Services, you agree to comply with this Policy.

Failure to comply may result in suspension or permanent termination of your account.

1. Purpose

Benitra is designed to help individuals and businesses create marketing and promotional content using artificial intelligence.

Users must use the Services responsibly, ethically, and lawfully.

You are responsible for all content you create, upload, generate, publish, or distribute using the Services.

2. General Principles

You agree that you will not use the Services:

  • unlawfully;
  • fraudulently;
  • deceptively;
  • maliciously;
  • in ways that infringe the rights of others;
  • in ways that could damage Benitra, its users, or third parties.

3. Illegal Activities

You may not use Benitra to:

  • commit crimes;
  • facilitate criminal activity;
  • evade law enforcement;
  • launder money;
  • finance terrorism;
  • violate sanctions;
  • distribute illegal products;
  • promote illegal services;
  • assist cybercrime;
  • facilitate identity theft.

4. Fraud and Deception

You may not use the Services to create content intended to:

  • deceive consumers;
  • impersonate individuals;
  • impersonate businesses;
  • conduct phishing attacks;
  • create fake testimonials;
  • create fake customer reviews;
  • manipulate public opinion through deception;
  • facilitate scams;
  • create fraudulent advertisements.

5. Intellectual Property

You may not upload or use:

  • copyrighted material without authorization;
  • trademarks you do not own or have permission to use;
  • copyrighted music without appropriate rights;
  • licensed photographs without permission;
  • protected artwork;
  • confidential third-party assets.

You are solely responsible for ensuring you possess all required rights.

6. Privacy and Personal Information

You may not use the Services to:

  • expose personal information without authorization;
  • publish confidential information;
  • generate doxxing content;
  • facilitate identity theft;
  • violate privacy laws;
  • process personal data unlawfully.

7. Malware and Security

You may not use the Services to:

  • distribute malware;
  • distribute ransomware;
  • distribute spyware;
  • distribute malicious code;
  • facilitate hacking;
  • create phishing infrastructure;
  • bypass authentication systems;
  • attack networks;
  • exploit vulnerabilities.

8. Spam

You may not use Benitra to generate or distribute:

  • spam;
  • unsolicited commercial messages;
  • bulk deceptive marketing;
  • fraudulent outreach;
  • fake newsletters;
  • automated deceptive campaigns.

9. Harmful Content

You may not create content intended to:

  • encourage violence;
  • encourage terrorism;
  • glorify criminal activity;
  • incite hatred;
  • encourage self-harm;
  • promote illegal acts.

10. Adult and Sexually Suggestive Content

Benitra may not be used to create, request, or distribute:

  • explicit pornography or sexually explicit material;
  • sexually suggestive or provocative content intended for adult audiences;
  • NSFW (not safe for work) imagery or video;
  • exploitative sexual material;
  • non-consensual intimate imagery;
  • sexual content involving minors;
  • sexually abusive content;
  • content using terms or prompts intended to bypass safety filters (including "uncensored," "no filter," or similar).

Marketing content must remain suitable for general business and commercial audiences.

11. Child Safety

Any content involving child exploitation, grooming, child sexual abuse material, or facilitation of harm to minors is strictly prohibited.

Accounts engaging in such activity will be permanently terminated and may be reported to the appropriate authorities where required by law.

12. Violence

You may not use the Services to generate content that promotes:

  • murder;
  • torture;
  • terrorism;
  • kidnapping;
  • violent extremism;
  • graphic violence intended to shock or glorify harm.

13. Hate Content

The Services may not be used to promote hatred or discrimination based on:

  • race;
  • ethnicity;
  • nationality;
  • religion;
  • gender;
  • gender identity;
  • sexual orientation;
  • disability;
  • age;
  • protected characteristics recognized by applicable law.

14. Harassment

You may not use the Services to:

  • threaten individuals;
  • bully individuals;
  • harass individuals;
  • intimidate others;
  • coordinate harassment campaigns.

15. Political Manipulation

You may not use Benitra to:

  • intentionally mislead voters;
  • impersonate public officials;
  • create deceptive political advertisements;
  • create fabricated election materials;
  • manipulate democratic processes through deception.

Nothing in this section prohibits lawful political expression where permitted by applicable law.

16. Deepfakes, Face Manipulation, and Impersonation

Benitra does not support and you may not use the Services to:

  • create deepfakes or synthetic media depicting real individuals;
  • perform face swaps or face replacements onto real or fictional persons;
  • manipulate, alter, or synthesize the face or likeness of any real person;
  • impersonate real individuals, public figures, celebrities, employees, or private persons;
  • upload photographs of real people for use as character references or likeness sources;
  • create deceptive AI-generated media intended to mislead viewers about a person's identity, statements, or actions.

Benitra is designed for marketing videos with AI-generated fictional characters only. Product images may be uploaded; images containing people are rejected by automated safety checks.

Where AI-generated media could be mistaken for depicting a real person, users remain responsible for applicable consent, publicity rights, and disclosure requirements.

17. Medical Content

Benitra is not intended to generate professional medical advice.

Users may not represent AI-generated content as professional medical guidance.

Medical marketing content must comply with applicable healthcare regulations.

18. Legal Advice

Generated content must not be represented as legal advice.

Users remain solely responsible for obtaining qualified legal counsel where appropriate.

19. Financial Advice

Benitra must not be used to create misleading financial advice or investment recommendations intended to deceive consumers.

Users remain responsible for regulatory compliance applicable to financial promotions.

20. AI Transparency

Users should not falsely represent AI-generated content as authentic human-created material where disclosure is legally required.

Users remain responsible for complying with applicable AI transparency laws.

21. Platform Abuse

Users may not:

  • attempt to bypass usage limits;
  • manipulate the credit system;
  • exploit technical vulnerabilities;
  • interfere with platform operations;
  • overload infrastructure;
  • abuse APIs;
  • create excessive automated requests;
  • attempt denial-of-service attacks.

22. Reverse Engineering

You may not:

  • reverse engineer the platform;
  • extract prompts;
  • extract AI models;
  • scrape generated outputs at scale;
  • benchmark the platform to build competing services;
  • copy workflows;
  • reproduce proprietary generation pipelines.

23. Automated Access

You may not access the Services using automated systems except through officially supported APIs or with Benitra's prior written authorization.

24. Commercial Competition

The Services may not be used to:

  • build competing AI products;
  • train competing AI systems;
  • develop competing prompt libraries;
  • reproduce Benitra workflows;
  • commercialize copied generation methods.

25. AI Model Training

Unless expressly authorized in writing, you may not use Generated Content, outputs, metadata, prompts, workflows, or other materials obtained through the Services for the purpose of training, fine-tuning, evaluating, or improving any artificial intelligence or machine learning model.

26. Monitoring, Moderation, and Enforcement

Benitra uses automated content moderation, including third-party screening APIs, to review prompts and uploads before image or video generation. Requests that violate this Policy may be blocked automatically.

Benitra reserves the right, but not the obligation, to investigate suspected violations of this Policy.

Where reasonably necessary, we may:

  • suspend accounts;
  • remove content;
  • revoke credits obtained through abuse or fraud;
  • restrict platform access;
  • terminate accounts;
  • cooperate with lawful requests from governmental authorities.

28. Updates

Benitra may modify this Policy from time to time.
